As in most states, child support in Maryland is calculated according to a specific formula set forth in Maryland's child support guidelines. The calculation takes into account the net income of both parents, the number of children being cared for, and the time each parent will spend as the primary custodian, as well as any extra expenses such as healthcare insurance and childcare costs.
However, just because child support in Maryland is calculated according to these strict guidelines, does not mean disputes do not arise during and after divorce proceedings about the amount of child support to be paid.
- Is income properly reported, so the child support calculation is accurate? Or, is one parent hiding a source of income?
- Is one parent voluntarily impoverishing him- or herself — that is, intentionally earning a lower income (or no income) to keep from having to pay child support?
- Have the financial circumstances of either parent changed substantially after the final divorce decree? If so, one parent may want to apply for a modification of the monthly child support payment amount.
In situations such as the ones described above, early advice from experienced family law attorneys can be extremely useful in understanding what your legal options are and what the outcome of any lengthy legal battle is likely to be.
